Overview

The introduction of the Property Factors (Scotland ) Act 2011 and its Code of Conduct asks that any factoring or property management relationships be formalised so that both the homeowner and the property factor know where they stand.

The council is required to invite all owners who do not have a factor clause in their title deeds to cast a vote in order to make a “scheme decision” by way of the Tenement Management Scheme set out in Schedule 1 of the Tenements (Scotland) Act 2004. A scheme decision is made by majority vote of all the votes allocated. Council owned properties will be counted as a vote in favour of retaining the council as property manager.

Why We Are Consulting

We are asking homeowners in mixed tenure blocks to vote on formally instating East Renfrewshire Council as their property factor where their title deeds do not state a factor clause.

What Happens Next

Once all votes have been cast and counted, homeowners will be issued with a relevant Written Statement of Services from the council. The Written Statement you receive will depend on the Factoring arrangement in place after you have cast your vote.
